three years” State Tourism Minister Dilip Parulekar told PTI Watch What Else is Making News Shack owners in the state were upset with the delay in the finalisation of Shack Policy by the government leading to ambiguity among them whether or not to erect temporary shacks (beach side eateries) The first chartered flight from Russia arrived on October 2 at International airport in Dabolim “We have allotted seven days to the applicants (shack owners) to apply for licence On the eighth day we will allot shacks Entire process will end in 10 days from now” the minister said He said the department will also table Shack Policy for three years period ie 2016-19 before the state cabinet in the coming week for approval Admitting that absence of Goa Coastal Zone management Authority’s (GCZMA) committee might be an impediment for shack owners as they require NOC from the authority Parulekar said GCZMA member secretary will be authorised to sign the documents (NOCs) GCZMA committee currently stands dissolved awaiting new appointments The shack owners however are aggrieved over the delay and claimed that tourists usually visit Goa to enjoy at shacks alongside beaches “Hotels market Goa in practice of instant triple talaq (File Photo) Related News Moving to make instant triple talaq or talaq-e-biddat a criminal offence the government is considering among changes in existing laws amendments to The Muslim Women (Protection of Rights on Divorce) Act 1986 Commonly known as the Shah Bano Act the 1986 law was enacted by the Rajiv Gandhi government under pressure from the Muslim clergy to overturn the Supreme Court ruling in the Shah Bano case This law allowed in line with Muslim personal law maintenance to a divorced woman only during the period of iddat or three menstrual cycles/three lunar months after divorce Officials said that changes to The Muslim Women (Protection of Rights on Divorce) Act 1986 was “one of the options discussed” and a final decision would be taken by a Group of Ministers (GoM) constituted to draft a law to make triple talaq a criminal offence According to officials the ‘preamble’ of the Shah Bano Act will have to be re-drafted since the existing law applies only after the divorce of a Muslim woman In August this year the Supreme Court declared talaq-e-biddat as illegal The draft legislation being enacted by the Law and Home ministries officials said will not only criminalise instant triple talaq but will also have provisions for imprisonment and fine or both for the offender Other than changes to the Shah Bano Act the government is considering amendments to provisions of Section 125 Code of Criminal Procedure (order for maintenance of wives children and parents) to provide further safeguards to Muslim women and their wards if they are abandoned via instant triple talaq the officials said Sources said the proposal to bring amendments to the Shah Bano Act was discussed last week by the GoM headed by Union Home Minister Rajnath Singh External Affairs Minister Sushma Swaraj who was part of the deliberations suggested amendments to the Shah Bano Act while Law Minister Ravi Shankar Prasad mooted suggestions to alter provisions of the CrPC and Indian Penal Code (IPC) On August 22 the Supreme Court in a landmark 3-2 verdict “set aside” the centuries-old practice of instant triple talaq in which Muslim men divorce their wives by uttering talaq three times in quick succession Three of the five judges on the Constitution Bench — Justices Rohinton F Nariman Uday U Lalit and Kurian Joseph — called the practice un-Islamic and “arbitrary” and disagreed with the view that triple talaq was an integral part of religious practice But the minority ruling of then Chief Justice J S Khehar and Justice S Abdul Nazeer underlined the primacy of Muslim personal law and said the practice enjoyed constitutional protection and was beyond the scope of judicial scrutiny They were of the view that Parliament should consider an “appropriate” law to deal with the issue of talaq-e-biddat While divorce is a civil matter government sources pointed out that the legislature was free to declare any unlawful/illegal offence in this case triple talaq as criminal A senior government functionary said ‘non-maintenance of wife and children’ after triple talaq declared illegal can be legislated to invite penal provisions The move to consider amendments to the Shah Bano Act offers powerful political optics for the ruling BJP which has been advocating a Uniform Civil Code The Shah Bano Act was enacted by the Rajiv Gandhi-led Congress government to overturn a Supreme Court order that sought to provide parity to Muslim women in maintenance after divorce The law was brought in after strong protests from the Muslim clergy who said the Supreme Court order amounted to interference in their personal laws Once the law outlawing triple talaq is enacted the Muslim clergy government sources said will have no role in cases of talaq-e-biddat and women can directly approach police for redressal The ministerial committee after its first meeting felt that laws related to marriage like the Domestic Violence Act and the Dowry Act were prone to misuse and safeguards would be required in the new legislation For all the latest India News download Indian Express App More Related NewsBy: post-poll survey by CSDS shows the significance of campaigning as more than one-third (38 per cent) of the voters decided whom to vote for during the campaign or close to the polling day The remaining 62 per cent had decided well before the campaign had begun which would be early January This could be attributed to the fact that Arvind Kejriwal had started his campaign roughly three to four months ago with a series of Delhi Dialogues Among the earliest decision-makers the AAP enjoyed a lead of 22 percentage points over the BJP The gap widens to almost 37 points among those who decided early during the campaign This probably justifies the BJP’s hasty decision of playing the Bedi gamble Again one could argue probably that the BJP had to do something out-of-the-box to have a chance The distress call by BJP in the last leg of campaigning by roping in the Prime Minister and his cabinet helped the party salvage some of its vote as the gap narrowed to some extent among those who decided close to voting (26 per cent) The intensive BJP campaign in the last 10 days seems to have been just enough for it to retain its core support group Share This Article Related Article Many in the BJP believe that adverse media coverage hampered its prospects On the contrary data from the survey indicates that the gap between the AAP and the BJP was relatively lower among those who watched news on television or read the newspaper daily A similar trend is also seen among users and non users of Facebook Twitter and WhatsApp We examine the overall visibility of the three campaigns and find that the Congress was almost absent Only one-fifth of the voters said a Congress candidate or a worker had come to their house as compared to more than 40 percent for both the BJP and the AAP Half the voters had not or had hardly seen any poster or banner of the Congress party during this election Despite similar visibility with the AAP it seems the BJP campaign failed to appeal to voters probably due to the high negative sentiment in their speeches and advertisements This election reinforces the lessons learnt in campaigning from the 2014 Lok Sabha elections This time the AAP ran a sustained campaign that peaked at the correct moment It was immature of the BJP to expect that only highlighting the achievements of the highly popular central government (62 per cent satisfaction rating) was enough for them to sway the city’s voters at the last moment with a few rallies by Modi The authors are associated with Lokniti CSDS and coordinated the post-poll survey For all the latest India News creating an amicable atmosphere within the state that would sustain the efforts at reviving and building the peace and reconciliation process started in 2003.“Peace and reconciliation has been the core agenda of our party and the hostile atmosphere around the State will one day have to yield place to reason and reconciliation” said the Chief Minister Mehbooba Mufti Watch What Else is Making shape Mehbooba who is also PDP president said Mehbooba was addressing a meeting of senior PDP leaders party Ministers Members of Parliament legislators and coordinators here Expressing pain at the loss of precious human lives during the current unrest in Kashmir the Chief Minister said she and her government are not looking out for a temporary truce but would focus on building an environment where such turbulences never visit the people again She said while PDP and its alliance partner BJP are committed to the implementation of the ‘Agenda of the Alliance’ a congenial atmosphere needs to be created within and around the State for its effective implementation Unfortunately we did not get any time to even start the implementation of Agenda of Alliance and some elements who thought that PDP is serious about the promises it made to the people started making attempts from day one to create hurdles and ultimately found an encounter as the trigger to exploit the sentiments she said Mehbooba said the positive impact that the government under the leadership of Mufti Mohammed Sayeed made between 2002-2005 was the result of the combination of circumstances important one being the readiness of Pakistan to enter into a dialogue process in response to the repeated peace overtures by the then Prime Minister Atal Bihari Vajpayee This time however the initiatives by Prime Minister Narendra Modi were unfortunately responded to with negativity and even hostility by Pakistan she said “But I am confident that the way forward for everybody is through acceptance of ground realities and offering relief hope and dignity to the people which could ultimately lead to permanent reconciliation peace and resolution in the region” Mehbooba said She said PDP was founded in the immediate aftermath of Kargil war and it was this party that first raised the banner of good relations between the two countries an agenda that was accepted by everyone in the following years Our party will never compromise on the need for peace as it is our state and its people who are the main victim of hostilities in the region she said Asking the party ministers to increase accessibility and interaction with the people Mehbooba said the current trouble should lead us to work with more zeal for the welfare of the people and revive the cadres of the party to act as emissaries of peace and turmoil cut short one of the best tourist seasons and revival of economic activities in the valley She said her government will provide succour in the revival of economy but those who are out to United Nations Human Rights Council (UNHRC) on March 28 the latest draft has restricted the time period of violations in Sri Lanka to be investigated by the Office of the High Commissioner for Human Rights (OHCHR) between 2002 and 2009 — the last seven years of the war between Lankan armed forces and the LTTE According to the changes in the draft resolution OHCHR will not probe into the allegations of human rights violations in the post-war period This also precludes Indian participation in the pre-2002 period especially during the Indian Peacekeeping Force mission in the late 80s The changes ties in well with New Delhi’s approach towards the Sri Lankan issue — that while the government is not averse to a probe into the violations during the last stage of the conflict it wants to focus on the post-war rehabilitation of Sri Lankan Tamil refugees and the reconstruction of the Northern province ravaged due to war The crucial paragraph 8 of the US-sponsored resolution has now been changed to mandate the OHCHR to investigate human rights abuses and violations in Sri Lanka “during the period covered by the Lessons Learnt and Reconciliation Commission (LLRC)” The LLRC which was formed to assuage the international community’s calls for reconciliation and accountability had studied the conflict between the signing of the ceasefire agreement in February 2002 and the conclusion of the war with the defeat of the LTTE in May 2009 The Indian Express had earlier reported that Indian negotiators were working towards softening the language of the resolution and this was anti-conversion law may be framed The Opposition however stuck to its stand that no debate can happen him Making his first intervention this session Leader of Opposition Ghulam Nabi Azad made a powerful pitch to the PM that his triumphs abroad have come because he represented the composite culture of India and having solicited votes in his own name it is imperative now that he should reply in the House “It is not derogatory to ask for votes for oneself All I am saying is it is pain he has inflicted he will have to cure it He had told the people of India that I am answerable give me power Today when it is the time to answer somebody else cannot answer on his behalf… there is no shame in heeding to the request of an elected legislature This is the PM’s home” Azad said as the treasury benches protested Azad’s contention that Modi sought votes not for the party but himself “America is watching this debate very closely We are happy that the Prime Minister is getting such rousing welcomes abroad but we must remember that it is happening because he represents the composite multi-religious culture of India…It was after he said that he represents all religions that the countries that had not allowed him in for 12-13 years welcomed him” Azad said In reply MoS Parliamentary Affairs Mukhtar Abbas Naqvi reiterated the government’s stand that the debate could happen provided the opposition obliged “We want a debate on conversion… It seems since you have come to the House after a long time … Your party colleagues did not brief you about what happened in your
